Abstract

Spanish Abstract: El artículo estudia las diversas modalidades de juramento extrajudiciales e judiciales en Hispanoamérica y Filipinas durante el período colonial. Bajo el aspecto teológico, el juramento era un acto de reverencia a Dios. Bajo el aspecto jurídico-canónico, el juramento tenía la finalidad de poner fin a las controversias. Debido a su ubicuidad, el juramento es mencionado en oficios, patronazgo regio, encomiendas, pleitos de indios, matrimonios, promesas y contratos. Se analiza, por consiguiente, las formas de jurar, las reglas para garantizar la honestidad y licitud del juramento, quién podía jurar, la dispensa del juramento, el perjurio y la jurisdicción que podría juzgar las causas que implican juramento. El trabajo analiza los cambios y continuidades que se dieron en el proceso de adaptación del derecho canónico y las leyes castellanas a la peculiaridad indiana.

English Abstract: The article studies the various forms of extrajudicial and judicial oaths in Spanish America and the Philippines during the colonial period. Under the theological aspect, the oath was an act of reverence for God. Under the legal-canonical aspect, the oath was intended to put an end to disputes. Due to its ubiquity, the oath is mentioned in offices, royal patronage, encomiendas, Indian lawsuits, marriages, promises and contracts. We analyze, therefore, the swearing rules, the rules to guarantee the honesty and legality of the oath, who could swear, the dispensation from the oath, the perjury and the jurisdiction that could judge the causes that imply oath. The work analyzes the changes and continuities that appeared in the process of adapting Canon Law and Castilian laws to the Indian peculiarity.
