Zniesławienie i Zniewaga w Polskiej Regulacji Prawnej (Defamation and An Insult in the Polish Legal Regulation)

Abstract

Polish Abstract: Zgodnie z polskim kodeksem karnym (dalej „kk”) zniesławienie jest pomówieniem (art. 212 § 1 kk) i może polegać na poniżeniu w opinii publicznej. Jest oczywiste, że mamy do czynienia w polskiej regulacji karnej z rażącym błędem merytorycznym: nikt nie może bowiem poniżyć publicznie kogokolwiek, jako że cześć i godność osobista są przyrodzone każdej prawdziwej naturze ludzkiej i niezbywalne. Jako takie nie mogą być zatem ex natura naruszone lub odebrane. Wnioskuję zatem najdobitniej, aby rozdział XXVII kk zmienił nazwę z obecnej („Przestępstwa przeciwko czci i nietykalności cielesnej”) na następującą: „Przestępstwa przeciwko utracie zaufania społecznego i nietykalności osobistej”. Piszę także o rażącej niesprawiedliwości i bezsensowności polskiej regulacji karnej zniesławienia i zniewagi w sferze przestrzegania wolności słowa oraz jej permisywności w sferze karania prawdziwych przestępców. Ponadto, w polskim kodeksie karnym nie istnieje definicja prawna przestępstwa zniewagi, co jest zupełnie błędne.


English Abstract: In accordance with the Polish penal code, defamation is libel/slander (art. 212 § 1 of the Polish penal code) and it can consist in humiliation in public opinion. It is evident that one observes a glaring substantive error in the Polish criminal regulation: indeed, nobody can humiliate anybody publicly, for honor and human dignity are innate to every authentic human nature and inalienable. Therefore, they cannot be ex natura infringed or taken away as such. In light of this, I am concluding in the clearest way that chapter XXVII of the Polish penal code should change its name from the current one (“Crimes against Honor and Bodily Inviolability”) to the following one: “Crimes against a Loss of Social Trust and Bodily Inviolability”. I am also writing about the gross injustice and senselessness of the Polish penal regulation of defamation and an insult in the sphere of observing the freedom of speech and its permissiveness in the sphere of punishing real criminals. Moreover, there is no legal definition of an insult in the Polish penal code, which is totally erroneous.
