Abstract
Consent obtained for sexual intercourse, by giving false promise of marriage can result in a conviction for the offense of Rape. When an accused acquires victim’s consent for having sexual intercourse with him on the pretext of marriage and never had any intention to marry her, then such consent is said to have been obtained by ‘misconception of fact’ under Section 90 of The Indian Penal Code, 1860.
