Abstract

Barbados is pushing to advance a digital development agenda. Central to this effort is an appropriate consumer protection framework. Passage of comprehensive data protection legislation is seen as critical to this effort.

Enter the Data Protection Bill, 2019. Prior drafts were floated as far back as 2005 and as recently as first quarter 2018. Following public comments, the 2019 edition of the Bill was crafted to reflect heavy inspiration from both the European General Data Protection Regulation and the United Kingdom's Data Protection Act, 1998.

While the dual sources of inspiration are clear, the application to the draft resulted in a proposed act with some unworkable elements.

This paper represents expanded commentary, following previous oral submissions to a Joint Select Committee of the Barbados Parliament by the author on June 26, 2019.
