This survey article discusses three developments over the last year. Part I reviews updated compliance and ethics program guidance released by the United States Department of Justice. Part II discusses how the National Labor Relations Board continues to develop its new approach to employer policies, focusing on workplace civility rules and the confidentiality of workplace investigations. Part III then turns to case law by examining a federal court of appeals decision that seemingly holds employers to a higher standard in preventing sexual harassment by supervisors.
