Abstract

This work is a qualitative research having as object the use of ADR instruments in the framework of R&D agreements among selected entities and professionals in Europe and whether such instruments are appreciated as a qualitative alternative to the ordinary court jurisdiction when the relation between the parties of an R&D agreement fall into crisis.

This research was inspired by the International Survey on Dispute Resolution in Technology Transactions performed by WIPO in 2013, with the intention of verifying how the use of ADR instruments has developed over the last five years, specifically related to the R&D agreements, providing other entities and professionals an overview of ADR instruments in order to evaluate their potentiality as crisis resolution instruments.
