Abstract

In recent years, there has been a flood of right of publicity litigation. These cases, involving social media, movies, video games, sports, advertising, and celebrity culture, are naturals for the classroom. This paper presents a primer on the right of publicity, including notable cases from 2018-19. It proposes ideas for classroom coverage, to help students realize the complexity of legal issues and competing policy concerns, including free speech and personal autonomy, and to encourage critical thinking about the practical business implications of publicity rights.
