Abstract

Dutch Abstract: Sinds jaar en dag wordt aangenomen dat inbreuk op een geldig octrooi resulteert in een verbod. Recente ontwikkelingen doen echter de vraag rijzen of deze regel nog houdbaar is. Het artikel biedt een overzicht van de status quo in Nederland en de veranderingen die mogelijk nopen tot heroverweging van de huidige praktijk. Het benoemt de belangrijkste vragen voor de rechtspraktijk en blikt vooruit op wat de octrooibalie te wachten staat.

English Abstract: It has long been accepted that infringement of a valid patent results in an injunction. Recent developments, however, raise the question whether this practice is sustainable. The article offers an overview of the status quo in the Netherlands and the changes that might prompt reconsideration of current practice. It addresses the most important questions for legal practice and looks ahead at what the patent bar might expect in years to come.
