Abstract

The public policy process is not interrupted by the sanction of a given policy. Actually, competing ideas might gain the agenda and overthrow the incumbent ones to become the new policy in effect. In the regulation of Information and Communications Technologies (ICTs), even their intrinsic business cycles can be disruptive. The example at hand is the upcoming International Mobile Telecommunications (IMT) standard, currently in development by the International Telecommunications Union (ITU) and other Standards Developing Organizations (SDOs) and fora. If on the one hand the new technology comes to solve existing and impending problems of the society at large, on the other hand, we argue, it might destabilize current policy frameworks. Specifically, we focus this study on how the regulation of network neutrality in Brazil might be affected by some of the technological innovations that constitute 5G, with emphasis given to Network Function Virtualization (NFV) and network slicing. In order to investigate the topic, we will begin by presenting an overview of the technology behind the International Mobile Telecommunications-2020 (IMT-2020), then we will expose the network neutrality problem and its regulation, in Brazil. Once this is accomplished, we will identify the disputes that might arise.
