Compliance en el Derecho Comparado. Primera parte: Una perspectiva introductoria desde la Alonomología (Compliance in Comparative Law. An Introductory Perspective From Alonomology)

Abstract

Spanish Abstract: Este trabajo es la introducción al estudio del Compliance en el Derecho Comparado desde la Alonomología, disciplina compuesta, teórico-práctica fundada por Werner Goldschmidt. Se desarrolla un enfoque interdisciplinario con los aportes de la Sociología para exponer la riqueza del análisis tridimensional de la normativa argentina introducida por la Ley 27.401, de Responsabilidad Penal de las Personas Jurídicas y favorecer la reflexión crítica de sus postulados, teniendo como objetivo que la norma sea adecuada a los objetivos que el Compliance propone y a la realización de la justicia, valor absoluto del Derecho.

English Abstract: This paper is the introduction to the study of Compliance in Comparative Law from the perspective of Alonomology, a composite, theoretical-practical discipline founded by Werner Goldschmidt. An interdisciplinary approach is developed with the contributions of Sociology to expose the richness of the three-dimensional analysis of the Argentine regulations introduced by Law 27.401, of Penal Responsibility of Legal Entities and to favour the critical reflection of its postulates, having as an objective that the regulation is adequate to the objectives that Compliance proposes and to the realization of justice, absolute value of Law.
