Introducción al Compliance en el Derecho Comparado. Primera parte: Alonomología. Common Law (Introduction to Compliance in Comparative Law. Part one: Alonomology. Common Law)

Abstract

Spanish Abstract: La propuesta de este trabajo consiste en presentar una serie de argumentos que sustenten la siguiente afirmación: para que el funcionamiento real del compliance sea efectivo en la República Argentina hay que tomar referencia de su evolución material en los sistemas que impulsaron su recepción, para lo cual la Alonomologia es la disciplina adecuada.

En virtud de ello se desarrollará una introducción a la disciplina, su valor interdisciplinario aportado por otros especialistas desde el fuera de ámbito jurídico (“Filosofía Jurídica Mayor”) que toma como referencia la ubicación del Derecho con otros objetos como el resto de la cultura.

Desde esa perspectiva efectuaremos un análisis del sistema del common law, donde surgió el instituto objeto de este trabajo y su evolución conjetural y real a través del tiempo (dimensión temporoespacial), desde sus primeros antecedentes hasta la Convención contra el Soborno Transnacional de la Organización para la Cooperación y el Desarrollo Económico (OCDE) que motivó su recepción en la normativa nacional.

Analizaremos si el reparto proyectado del compliance alcanza a ser un reparto realizado -de la adjudicación debida- (dimensión sociológica) y efectivizado por las normas que lo captan (dimensión normológica) y finalmente, si su deber ser ideal pasó por el deber ser aplicado y se convirtió en deber ser concretado (dimensión dikelógica).

English Abstract: The proposal of this paper consists in presenting a series of arguments that support the following statement: for the real functionality of Compliance to be effective in the Argentine Republic, we must take reference to its material evolution in the systems that promoted their reception, for which Alonomology is the appropriate discipline.

To this end, an introduction to the discipline will be developed, its interdisciplinary value contributed by other specialists from outside the legal area ("Major Legal Philosophy"), which takes as a reference the location of the Law with other objects like the rest of the culture.
From this perspective we will carry out an analysis of the common law system, where the institute object of this work emerged and its conjectural and real evolution through time (temporospatial dimension), from its first antecedents to the Convention on combating bribery of foreign public officials in international business transactions of the Organization for Economic Cooperation and Development (OECD) that motivated its reception in national regulations.

We will analyze if the projected “partition” (“reparto”) of compliance becomes a “partition” (“reparto”) made -from the due adjudication- (sociological dimension) and made effective by the norms that cap-ture it (normative dimension) and finally, if its "ought to be" ideal went through the "ought to be" applied and became a "ought to be" concretized (dikelogical dimension).
