Abstract

This paper aims to discuss the existence and features of the European criminal policy – which is definitively different from the separate criminal policies of the Member States. The most important feature of European criminal policy has been identified as the resistance towards direct and indirect (party) political influences which is generally very common in every Member State by designing national criminal policy. Furthermore, the paper presents the so-called area-independent attributes (European territoriality, mutual trust, functionality of EU law, human rights protection) of the European criminal policy, and examines the recent challenges these elements are facing due to the latest developments within this area.
