Abstract

The de minimis exception gained significant importance in the law of the United States. In the law of the United States the de minimis exception functions as a safety valve or a balancing tool. It has two main dimensions. First, a “substantive de minimis exception” focuses on the subject matter, and, second, a “procedural de minimis exception” has an infringement-oriented perspective. The EU copyright law lacks such a doctrine. This paper analysis the US and the EU case law on sampling, and concludes why the de minimis exception could have a role in EU copyright law as well.
