Abstract

Portuguese Abstract: Este artigo conclui que as contribuições obrigatórias para a segurança social, em Portugal, revestem o caráter de imposto. Consequentemente, os requisitos impostos pela Constituição devem sempre ser observados. Esta conclusão retira a validade de alguns aspetos do regime jurídico destas contribuições, como descrevemos extensivamente no artigo. Os autores consideram que urge que o legislador respeite os requisitos constitucionais, de modo a evitar um possível e previsível conflito de validade dos referidos aspetos.

English Abstract: This article argues that Portuguese social security contributions fulfil all the characteristics of a tax. As a consequence, the constitutional agenda and requirements for taxes are fully applicable. This conclusion undermines the validity of some aspects of the legal regime of those contributions, as the article explains at length. The authors urge the legislator to observe the constitutional requirements, avoiding a possible and foreseeable dispute on the validity of those contributions.
