Abstract

This working paper presents the results of research carried out by the environmental policy team of the SoLaR network. The research examined how the Commission’s guidelines and recommendations in the field of EU environmental law are transposed and complied with in some selected Member States: Finland, France, Germany, Italy, the Netherlands, Slovenia and the UK. The research has also studied the attitudes of the administrative authorities and judges regarding environmental soft law, in particular the potential differences in the attitudes across the Member States. The focus of the research lies primarily on the use of soft law instruments issued in the framework of three directives: the Habitats Directive 92/43/EEC, the Water Framework Directive 2000/60/EC and the Environmental Impact Assessment Directive 2011/92/EU.
