Abstract

Spanish abstract: El presente artículo parte de las concepciones de constitucionalismo transformador y de Ius Constitutionale Commune en América Latina (ICCAL), con el fin de responder a dos preguntas: 1.- ¿Existe un constitucionalismo transformador en desarrollo en Brasil? 2.- ¿El constitucionalismo transformador y el ICCAL pueden contribuir a la experiencia con- stitucional brasileña? En respuesta a tales preguntas, el trabajo expone el carácter parcialmente transformador del con- stitucionalismo en Brasil. Demuestra que tal constitucionalismo carece de un diálogo con la Corte IDH y con los demás tribunales de los países latinoamericanos. Por fin, sostiene que la adhesión de las cortes brasileñas al ICCAL es impor- tante, no sólo para el avance en cuestiones de derechos fundamentales, democracia y estado de derecho, sino también para la resiliencia contra el retroceso en estos mismos temas.

English abstract: The article presents the doctrine of trans-formative constitutionalism and of Ius Constitutionale Commune in Latin America (ICCAL), in order to answer two questions. First: Is there a trans-formative constitutionalism in development in Brazil? Secondly: Do trans-formative constitutionalism and ICCAL have a contribution to offer to the Brazilian constitutionalism? The paper argues that the Brazilian constitutionalism has a partial trans-formative character, but lacks a serious dialogue with the Inter-American Court of Human Rights and with other Latin American courts. It also demonstrates that joining ICCAL is important not only for advancing the implementation of fundamental rights, democracy and the rule of law, but also for improving resilience against setbacks in these issues.
