Abstract

This paper summarizes major developments in environmental cases during the 2012-13 term, during which the U.S. Supreme Court has had a fairly active environmental law docket involving recurrent issues of what constitutes a compensable taking under the 5th Amendment and a discharge under the Clean Water Act. It also has before it a few other cases that could have an impact on environmental law and litigation in Pennsylvania and beyond. This overview concludes with a recap of the Sebelius case – decided after last year’s Forum – which while concerning the federal Health Care Act could affect the implementation of federal environmental laws.
