Abstract

Comments on Kavala v Turkey (28749/18) (ECtHR) on whether the detention of a protestor since 2017 infringed his right to liberty and was intended as an unlawful punishment for his criticisms of the Government, in breach of ECHR arts 5 and 18. Discusses how Turkey's subsequent release and re-arrest of the applicant as part of a new investigation rendered the judgment futile, and considers the implications for the rule of law in the jurisdiction.
