Abstract

Spanish Abstract: Este artículo versa sobre la aportación de Juan Pablo II al derecho, como hombre de Estado, líder mundial y pastor de la Iglesia católica. Juan Pablo II se acercó al derecho desde la experiencia de haber sufrido en carne propia la injusticia de dos sistemas totalitarios y las crueldades de la Segunda Guerra Mundial. Gran defensor de los derechos humanos, sobre todo de los derechos a la vida y a la libertad religiosa, Juan Pablo II vio en la dignidad y la solidaridad las dos grandes palancas para el desarrollo de los ordenamientos jurídicos. El artículo analiza también la importante contribución jurídica de Juan Pablo II como legislador del derecho canónico. A él se debe la promulgación del Código de Derecho Canónico de 1983, el Código de los cánones de las Iglesias orientales de 1990 y la Constitución apostólica Pastor Bonus de 1988, sobre reforma de la organización y gobierno de la curia romana. Por estas relevantes aportaciones, Juan Pablo II bien merece el título de jurista.

English Abstract: This article examines John Paul II's contribution to the law as a statesman, world leader and universal pastor of the Roman Catholic Church. John Paul II's approach to the law was shaped by the stark realities of having suffered firsthand the injustice of two totalitarian regimes and the cruelties of the Second World War. An ardent defender of human rights, especially the rights to life and religious liberty, John Paul II saw in the dignity of man and in human solidarity the two great levers for furthering the development of legal systems. Lastly, this article explores John Paul II's invaluable role in updating and reforming the Church's Canon Law. He had a singular role in promulgating the Code of Canon Law of 1983, the Code of Canons of the Eastern Churches of 1990, and the Apostolic Constitution Pastor Bonus of 1988 on reforming the Roman Curia organization and government. For these and other relevant legal contributions, John Paul II well deserves the title of jurist.
