Abstract
This study is a descriptive study that providing data accurately regarding state role in conducting educational development and fulfilling education right. Therefore, this study is evaluative and prescriptive study due to this study provide in-depth analysis on state that must provide adequate educational support facilities, the state must provide adequate number of teachers and educational staff and having competent. The state must be present in the form of budget politics that supports the development of education in borderland, while prescriptive study because this study will also provide the right solution that state must provide curriculum that is relevant with the needs of school-age children in borderland at the same time improving their insight into their nationality, the state must fulfill human rights (duty bearer) and this study aims to be normative legal study and literature.
