Kosher and Halal Slaughtering Before the Court of Justice: A Case of Religious Intolerance? שחיטה כשרה וחלאל בפני בית הדין האירופי לצדק: מקרה של חוסר סובלנות דתית?

Abstract

English Abstract: In December 2020 the Court of Justice of the EU approved the legality of a decree, adopted by the Flemish Region in Belgium, which introduced an outright ban on slaughtering of animals by means of traditional Jewish and Muslim rites. The Court, which did not adopt the opinion of Advocate General Hogan, effectively nullified an express derogation for ritual slaughtering found in the EU’s regulation on slaughtering. This article will critically examine the Judgment, arguing that it has not only misinterpreted EU regulations, but also compromised the rights of European minorities to religious freedom under the Charter on the basis of questionable and inconsistent arguments of animal welfare.

תקציר בעברית: בדצמבר 2020 בית הדין האירופי לצדק, בית המשפט העליון של האיחוד האירופי, אישר את חוקיותו של חוק שאומץ על-ידי המחוז הפלמי בבלגיה ואשר הטיל איסור על שחיטת בעלי חיים בהתאם לדיני הכשרות המסורתיים של ההלכה היהודית והשריעה המוסלמית. בית הדין, אשר החליט שלא לאמץ את חוות דעתו של הפרקליט הראשי שלו, למעשה איין חריג מפורש עבור שחיטה דתית המהווה חלק מהתקנות של האיחוד האירופי על שחיטת בעלי חיים והפך אותו לחסר משמעות. מאמר זה בוחן את פסק הדין באופן ביקורתי, וטוען שבית הדין לא רק פירש באופן שגוי את התקנות האירופיות, אלא גם פגע בזכותם של מיעוטים דתיים באירופה לחופש דת על-פי מגילת הזכויות הבסיסיות של האיחוד האירופי, וזאת על יסוד טיעונים מסופקים ובלתי עקביים בדבר רווחת בעלי-חיים. המאמר מביע את החשש שפסק הדין יוביל לכך שעוד מדינות באירופה יאמצו איסורים דומים על שחיטה כשרה, כפי שבינתיים אכן קרה ביוון.
