Kinderrechte, Schutzpflichten und der Ermessensspielraum der Exekutive in der COVID-19 Pandemie (Children’s Rights, Protective Duties and the Executive’s Margin of Appreciation in the COVID-19 Pandemic)

Abstract

German Abstract: Der Schutz von schulpflichtigen Kindern in einem Alter in dem aktuell noch keine Impfung gegen COVID-19 möglich ist gegen eine Infektion mit dem SARS-CoV-2 Virus stellt aktuell auf mehreren Ebenen eine Herausforderung sowie ein politisch umstrittenes Thema dar. In diesem kurzen Text wird dargestellt, dass der Entscheidungsspielraum politischer Entscheidungsträger durch verfassungsrechtliche Vorgaben eingeschränkt ist. Es besteht eine positive Schutzpflicht des Staates. Diese hat zur Folge, dass Maßnahmen getroffen werden müssen, die einen effektiven Gesundheitsschutz bewirken. Die rechtlichen Grundlagen hierfür werden hier aufgezeigt.

English Abstract: The protection of children who are obliged under German law to attend school and who are of an age for which no vaccination against COVID-19 is possible at this time against an infection with the SARS-CoV-2 currently poses a challenge on multiple levels, as well as a controversial political topic. In this short text it will is shown that the margin of appreciation of political decision-makers is limited. The state has a positive dutz to protect. It follows from this that measures must be take that provide effective protection of health. Here, the legal bases for this protection are shown.
