Abstract

The constitution of Kenya 2010 created a quasi-federal system of governance where devolved power is donated to the forty seven county governments. New positions of county governor and deputy county governor were created, with governors being the executive heads of county governments to be deputized by the deputy governors. As the offices are held in public trust, it may be imperative to hound out of office through impeachment governors or their deputies whose conduct falls below that of the man on the clapham omnibus. To that extent this paper looks into the impeachment process of governors in Kenya and the incidental challenges thereto. It argues among other things, that the constitution of Kenya does not contemplate handing over of power from an acting governor to a deputy governor.
