Legal Ontology: Does 'The Law' Exist?

Abstract

People in all walks of life, but especially lawyers and judges, often refer to “the law.” But is “the law” something that exists? The paper considers that question, with special attention to the works of Eric Voegelin and Steven D. Smith, who each, in his own way, considered the question. The paper also seeks to illuminate the question by considering the current practice of law, law in the United States Supreme Court, law in prehistory and history, and other thinkers on law.
