Abstract

The diversity in mediation practices, as well as the numerous mediation institutions/mediators, makes it difficult to impose uniform and effective quality control standards on mediation. This problem may negatively impact the successful implementation of the United Nations Convention on International Settlement Agreements Resulting from Mediation (Singapore Mediation Convention). As to the efforts to address such diversities and assure the quality of settlement agreements, this article suggests that among others, they may include categorizing mediation services, introducing compulsory training and accreditation for mediators, and enhancing minimum desirable standards for international commercial mediation.
