Abstract

On 28 January 2021, a Special Chamber of the International Tribunal for the Law of the Sea handed down a judgment on preliminary objections in the Dispute concerning Delimitation of the Maritime Boundary between Mauritius and Maldives in the Indian Ocean. This case note analyses the judgment with a focus on its expansive interpretation of the Chagos Advisory Opinion of the International Court of Justice and the 'legal effect' that the Special Chamber ascribes to the Opinion.
