Abstract
The State Antitrust Enforcement Venue Act of 2021 is a solution in search of a problem. If enacted it would give states powers not enjoyed by federal enforcers, increase the likelihood of gamesmanship, and diminish the substantial benefits of the Multi-District Litigation Act, 28 U.S.C. §1407, enacted in 1968, that created the Judicial Panel on Multi-District Litigation.
