Abstract

This amicus brief was filed in support of Mexico's suit against Smith & Wesson and other U.S. gun manufacturers. The brief, joined by sixteen professors of transnational litigation, responds to two arguments in the defendants' motion to dismiss. First, the brief argues that the Protection of Lawful Commerce in Arms Act (PLCAA) does not bar suits brought under foreign law. Second, the brief argues that neither international law nor international comity prevent Mexican law from applying to conduct in the United States that causes substantial effects in Mexico.
