Abstract
This Response to Professor Swan's article, Constitutional Offloading at the City Limits, 135 Harv. L. Rev. 831 (2022), argues that courts' differential treatment of local governments based on size relies on questionable stereotypes and risks exacerbating political, cultural, and economic urban/rural divisions.
