Abstract

Spanish Abstract: Los Smart Contracts son una tecnología derivada de la ramificación del Internet, cuyo impacto en el Derecho, a través de su uso conjunto con blockchain, es constituir una alternativa a los mecanismos tradicionales de formalizar relaciones. Incorporando todos los objetivos principales del diseño de los contratos, pero reduciendo sus costos transaccionales.

Considerando que sus protocolos cumplen todos los elementos para la existencia de una obligación. Su uso práctico consiste en albergar y autoejecutar la codificación de las prestaciones de un acto jurídico generador de obligaciones, cuyas condiciones tengan una solución algorítmicamente determinable. Y donde el objeto de estas prestaciones, versarán sobre activos digitales.

La capacidad de la institución de servir como una herramienta, para plasmar declaraciones de voluntad encaminadas a producir efectos legales, hace necesario que su naturaleza jurídica sea clasificada dentro de un concepto amplio, siendo el de los mecanismos de consentimiento el más apto para ello.

English Abstract: Smart Contracts are a technology derived from the ramification of the Internet, whose impact on Law through its use alongside blockchain, is to constitute an alternative to the traditional mechanisms of formalizing relationships. Incorporating all the main objectives of contract design, but reducing their transactional costs.

Considering that its protocols fulfill with all the elements for an obligation to exist. Its practical usages consist of hosting and self-executing the encoding of the rendering of a legal act that generates obligations, whose conditions have an algorithmically determinable solution. And where the object of these renderings, will handle digital assets.

The capacity of the institution to serve as a tool, for the embodiment of declarations of will aimed at producing legal effects, needs for its legal status to be classified within a broad concept, being that of consensus mechanisms the most suitable for this purpose.
