Abstract

Equine law covers all aspects of horses and horse related activities and industries. Under common law, liability for harm to persons by horses were determined based upon traditional tort law concepts such as assumption of risk and comparative negligence. Today 48 states have adopted some form of the Equine Activity Liability Act. The purpose of the EALA is to encourage equine activities by limiting tort liability of individuals who organize or sponsor equine events and activities. Liability is determine on a state by state basis.

This article covers New York Equine Liability Act and Michigan Equine Liability Act. Also, covered are contracts, equine related insurance, trial practice, trial themes and helpful equine sources of information.
