Abstract

Part II of the chapter deals with the constitutional history of the framing of India’s constitution and why education was not made a fundamental right. Part III will cover post-independence discourse on education in first three decades. Part IV shall deal with developments which led to declaring of education as a fundamental right. Part V will deal with contestations which affected the framing of Right of Children to Free and Compulsory Education (RTE) Act, and the contents of the Act. Part VI will deal with judgments on the validity and scope of RTE Act, in particular to the rights of minority educational institutions. In part VII of this article, I will cover the controversies surrounding languages of instruction in schools. Part VIII will be conclusion.
