پاکستانی فوجداری نظام میں توہینِ رسالت کی سزا اور بین الاقوامی انسانی حقوق: ایک تقابلی جائزہ (Punishment of Blasphemy in Criminal Justice System of Pakistan and International Human Rights Law: A Comparative Analysis)

Urdu Abstract:  ماضی قریب میں ملکی اور بین الاقوامی سطح پر توہین رسالت کے جرائم میں غیر متوقع اضافہ دیکھا گیا ہے اور ہر گزرتے دن کے ساتھ اس طرح کے واقعات بڑھتے جا رہے ہیں، جو ایک تشویشناک امر ہے ۔ عمومی طور پر دیکھا گیا ہے کہ اس طرح کے واقعات کو آزادئ اظہار رائے جیسے بین الاقوامی انسانی حقوق کے تحت جواز فراہم کر دیا جاتا ہے ، اور یہ باور کرایا جاتا ہے کہ توہین رسالت پر سزا کا قانون ہر لحاظ سے بین الاقوامی انسانی حقوق کے ساتھ متصادم ہے۔
درایں حالات اس بات کا جائزہ لینے کی اشد ضرورت ہے کہ کیا ان حقوق کے تحت توہینِ رسالت کے جرم کو جواز فراہم کیا جا سکتا ہے؟ کیا توہین رسالت پر سزا کے قوانین ان انسانی حقوق کے ساتھ متصادم ہیں؟ کیا یہ حقوق ہر طرح کے حدود وقیود سے ماوراءہیں؟ اگر ان حقوق پر کوئی قدغن لگائی جا سکتی ہے تو اس کے اصول کیا ہوں گے؟زیر نظر مقالہ ان سوالوں کا جواب دینے کے ساتھ ساتھ اس نکتے پر بھی مشتمل ہے کہ کیا بنیادی انسانی حقوق کے بین الاقوامی اصول اور اسلامی اصول میں یکسانیت ہے یا دونوں کا موقف جداگانہ ہے؟ بصورت دوم دونوں میں تطبیق کا کوئی امکان ہے؟ اس کے ساتھ ساتھ مقالہ میں یہ وضاحت بھی کی گئی ہے کہ توہینِ رسالت پر سزا کا پاکستانی قانون ، بین الاقوامی انسانی حقوق کے کون کون سے وثائق سے متصادم ہے اور اس بارے میں شرعی اور قانونی موقف کیا ہے؟

English Abstract:  The last two decades have been witnessing an overwhelming escalation in the commission of blasphemy, both on national and international levels. Generally, attempts are made to justify it on the basis of freedom of expression, guaranteed under international human rights law (IHRL). Laws of Muslim states relating to the blasphemy are facing critique for not being in line with IHRL. This poses a few questions: Can blasphemy possibly be justified under the fabric of the freedom of expression guaranteed under IHRL? Are laws of Muslim states relating to blasphemy in contradiction to IHRL? What are the implications of the freedom of expression? Is there any restriction on this right? In addition to attempting these questions, the paper aims to shed light on the nature and relation between IHRL and Islamic law. The paper also discusses the possibility of the reconciliation between both systems if the contradiction is assumed. The work also discusses how the current law of blasphemy in Pakistan runs contrary to certain provisions of IHRL and how it may be fixed from the perspective of Islamic law and IHRL.
