Abstract

This article analyses the emergence and development of Confidential information/Trade secret law from the common law period to the present position in India and the role of TRIPS in trade secrets. It also discusses widely about liability for misappropriations, prominence of Non-disclosure agreements and Breach of trust. The purpose of this article is to study the protection methods of confidential information, the defences and remedies available by a way of equitable relief in the absence of specific legislations for such misappropriations along with the new and International developments.
