Abstract

The article focuses on the landscape of the liability of intermediary service providers in a digital space. It is an overview of the proposed by the European Union policymakers Digital Services Act – its background, main provisions, and its relation to the eCommerce Directive. In particular, the article discusses the impact that Digital Services Act may have on the file-sharing platforms, which have been facing issues with scope of their responsibility and imposed obligations while following the eCommerce provisions for the last 20 years.
