Abstract

The Supreme Court of Canada's decision in R v Brown raises questions about the appropriate role of different categories of principles of fundamental justice under section 7 of the Charter. The article argues that the Court should employ principles of criminal law theory over principles of instrumental rationality when striking down a law under section 7 of the Charter.
