Abstract

The article explores the scope and relevance of adopting a gender perspective in competition law, motivated by the 'Gender Inclusive Competition Policy' project launched in 2018 by the OECD and the Canadian Competition Bureau. The paper reviews the concept of gender and its relevance in the legal system, in addition to providing examples of its inclusion in different areas of competition law. In particular, the author proposes to work behind the gender lens regarding market definition in mergers and studies, areas where international opinion has observed that, a priori, a harmonious outcome emerges in terms of promoting efficiency and gender equality.
