Abstract

The power to determine and implement the grounds for the acquisition of an EU Member State’s nationality lies at the core of that state’s autonomy in matters of nationality, so too therefore the power to introduce citizenship by investment schemes. Such schemes must in principle be considered compatible with international and EU law. However, this national autonomy is not unlimited. We will therefore explore the limitations of Member State autonomy in general and specifically with a focus on citizenship by investment schemes.
