Os atos de improbidade administrativa, segundo a jurisprudência do Superior Tribunal de Justiça, exigem a presença cabal do elemento subjetivo do dolo para sua configuração – admitindo-se, para além deste, a culpa, segundo majoritária doutrina, nos casos dos atos descritos no artigo 10 da Lei nº 8.429/92, que causem prejuízo ao erário. Há, contudo, diferença entre irregularidades e ilegalidades oriundas da prática do ato do improbidade administrativa propriamente dito. Analisa-se, portanto, a necessidade da má-fé e da intencionalidade do agente público na prática de tais atos para que venha a ser condenado pelas condutas descritas na LIA – Lei de Improbidade Administrativa.

English Abstract
Acts of administrative improbity, according to the precedents of the Brazilian Supreme Court of Justice, demand the presence of the subjective element of intent – or, according to the majority of the doctrine, serious fault, on those cases of article 10 of the Law n. 8.429/92, the ones that cause damage to the public coffers. There are, however, differences between irregularities and illegalities from those acts of improbity, per se. Therefore, the present article analyses the need for subjective intentionality and bad faith in doing these acts to convict the public agent on the punishment of the Administrative Improbity Law.
