Abstract

This draft paper examines the Brazilian Supreme Court's landmark decision on whether Jehovah’s Witnesses may refuse blood transfusions occasionally needed after or during surgical procedures as per the two cases brought before the Court (RE 1.212.272 and ADPF 618). The comment analyses the history of the Brazilian STF's position on the matter and compares it with the jurisprudence of other constitutional courts in the world.
