Abstract

This amicus brief was filed with the U.S. Court of Appeals for the First Circuit in support of Mexico's suit against Smith & Wesson and other U.S. gun manufacturers. The brief, joined by eleven professors of transnational litigation, argues that the Protection of Lawful Commerce in Arms Act (PLCAA) does not bar claims under foreign law and claims by foreign governments, that Mexico's non-statutory claims are properly governed by Mexican law, and that neither international law nor international comity bars those claims.
