Abstract

India’s significance for international commerce requires no evidence. India is also blessed by a rich arbitration history, but the trajectory of its arbitration law has been described over the years as “one step forward, two steps back.” Currently, the momentum is progressive and the judicial approach has shifted from judicial interference towards support and assistance in arbitral proceedings. This is a good time to publish a comprehensive book on India’s arbitration law and practice and compare it to international standards. It is particularly laudable that someone with the experience, knowledge and global reputation of Professor Datuk Sundra Rajoo is embarking on such a mission. He is lending his international perspective to Indian law and practice and provides— supported by Indian practitioners—a comprehensive magnum opus which will not only assist Indian and international arbitration practitioners but has the potential to even shape the future Indian arbitration practice.

Keywords: global arbitration practice, Indian Arbitration and Conciliation Act, Indian arbitration law and practice, investment arbitration, transformative change, UNCITRAL Model Law
