Abstract

In our time, notions of harm and offense, and the legally recognized incidents thereof, have been variously expanding, contracting, undergoing re-direction and re-focusing, and increasingly overlapping, if not merging into practical indistinguishability. In these respects, the mutations of judicially cognizable harm and offense have both tracked, and contributed to, our descriptive and our normative cultural judgments.
