Abstract

This case note summarizes and comments on the General Court's judgment in the Polwax case (Case T-585/20, Polwax v. Commission, EU:T:2023:332, 14 June 2023). That judgment is one of only a few judgments from the EU courts dealing with vertical effects in merger cases. The case was triggered by a third-party challenge against the European Commission’s clearance of a merger between two Polish oil refiners: KPN Orlen and Grupa Lotos.
