Abstract

This essay discusses my impressions of Judge Rakoff, based on expert witness testimony in a hearing for a preliminary injunction concerning a proposed auction foreclosure sale of certain financial assets under the Uniform Commercial Code (“UCC”). The essay also provides an anatomy of the UCC foreclosure of assets.
