Abstract

This amicus brief was filed in FTC v. Illumina, a Fifth Circuit case dealing with the application of SEC v. Jarkesy's nondelegation holding to the FTC. The brief argues that even if Jarkesy's remains good law, a century of precedent suggests that the FTC is guided by an intelligible principle.
