Abstract

How a country allocates cases among its courts depends upon the nature, values, traditions, and history of that country. Focusing on the longstanding distinctions between civil-law and common-law traditions, this chapter explores how countries allocate cases through judicial jurisdiction and competence. After setting out the features of jurisdiction and competence in the two traditions, the chapter concludes with observations and reflections.
