Abstract

It is in this new global and regional paradigm that considers the decriminalization of abortion as a human rights imperative[12] that ADPF 442 is inserted. The jurisprudence of the Federal Supreme Court (STF) has provided relevant precedents on the gradual legal protection of human life in development, and affirmed the fundamental rights of women and girls related to reproductive autonomy. Now the STF has ADPF 442 in its hands and the opportunity to continue advancing in the protection of reproductive rights and declare the constitutionality of the voluntary termination of pregnancy in the first 12 weeks of pregnancy. The favorable vote of the rapporteur, Minister Rosa Weber, on the first day was celebrated as a historic milestone in the fight for the decriminalization of abortion, bringing new winds affirming reproductive justice and the autonomy of women, girls and people who strive to define, free from discrimination, violence and coercion, their life projects within the scope of the democratic rule of law.
