Abstract

This essay is part of a Chicago Law Review Symposium on the current draft of the Restatement of Children and the Law, expected to be approved by the American Law Institute in May, 2024. Professor Bonnie, who is a Reporter for the Restatement, focused his paper on two commentaries focusing on children in the justice system. The first is an essay by Professor Thomas Grisso on adolescent decisional capacity, including competence for adjudication and waiver of rights in police interrogation. The second paper focuses on Professor Kristin Henning’s challenging essay on racial and ethnic disparities in the juvenile justice system.
