Abstract

Spanish Abstract: Este artículo brinda una introducción a la historia del derecho canónico en Hispanoamérica y las Filipinas en la época colonial, sus fuentes, su dinámica y su interrelación con otros saberes normativos, como son la teología moral, el derecho secular en materia religiosa y sus respectivas prácticas. Concebido como introducción al DCH (https://dch.hypotheses.org/) el artículo se estructura en cuatro partes. La primera contiene una breve introducción histórica al derecho canónico. En la segunda parte, se presenta un balance de la historiografía acerca del derecho canónico en Europa y en las Indias, y se propone una metodología que puede ayudar a superar algunas de las limitaciones de los acercamientos tradicionales. En la tercera parte, y siguiendo la metodología propuesta, se introducen los cuerpos de saber normativo más importantes, sin limitarse al derecho canónico en sentido estricto. El artículo concluye con una breve reflexión sobre algunas perspectivas importantes para el estudio del derecho canónico en Indias. 

English Abstract: This article provides an introduction to the history of canon law in Spanish America and the Philippines in the colonial period, its sources, its dynamics and its interrelation with other knowledges of normativity from the religious sphere, such as moral theology, secular law in religious matters and their respective practices. The essay consists of four parts. The first offers a brief historical introduction to canon law. The second part presents a brief review of the historiography on canon law in Europe and the Indies and proposes a methodology that can help to overcome some of the limitations of traditional approaches. In the third part, and following the proposed methodology, the most important bodies of normative knowledge are introduced, not limited to canon law in the strict sense. The article concludes with a brief reflection on some important perspectives for the study of canon law in the Indies.
